This Agreement shall commence upon the date of acceptance by ARInternet, and may be canceled by either the Customer or ARInternet only upon written notice to the other. It shall be the responsibility of the Customer to keep ARInternet informed as to a valid mailing address to which written notice may be sent.Customer Responsibilities:
Services provided to the Customer by ARInternet may be used only for lawful purposes, and Customer shall comply with all proprietary and restrictive notices that may appear on the Internet. Transmission or storage of any information, data or material in violation of any Federal, State or local regulation or law is expressly prohibited, including, but not limited to, the unlawful or improper use of material protected by copyright, trade secret, or any other statute, law, rule, or regulation. The Customer is responsible for adherence to any rules or regulations pertaining to the communications means by which the Customer connects their terminal or PC to any service provided by ARInternet. The Customer warrants, represents and certifies that he or she is at least 18 years of age. The Customer further warrants, represents and certifies that he or she understands that adult and other materials which may be inappropriate for certain users, including those under the age of 18 years, are available on the Internet. Customer as parent or legal guardian of a minor shall be fully responsible for the minor's use of ARInternet's facilities and shall be solely liable for any misuse by such minor. Customer hereby agrees to indemnify and hold harmless ARInternet from and against all liability and/or damages, including reasonable attorneys' fees, arising out of or related to the authorized or unauthorized use of Customer's ARInternet account by such minor or any other person. Use of an ARInternet account for the purpose of harassment, sabotage, or any unlawful activities (be it intentional or otherwise) is prohibited. Such activities include, but are not limited to: 1) Harassing others via e-mail/usenet news: a) Posting of chain letters b) Posting of multiple off-topic messages to mailing lists/newsgroups intended to provoke "flame-wars." c) Posting binaries to discussion-only newsgroups. d) Mass postings of unsolicited materials. e) Posting of copyrighted material without express written consent of the copyright holder. f) Attempts to forge message header information. 2) Hacking: a) Attempts to log into accounts, systems, or to access information without authorization. b) Attempts to create, obtain, compile, execute, or distribute programs, scripts or instructional material of a malicious and/or destructive nature. Note: If any of the above are unclear, ARInternet may be contacted for clarification.Fees and Payment:
The charges for the service provided to the Customer are shown on the currently effective price list which has been provided to the Customer. ARInternet reserves the right, at its discretion, to modify these charges, upon thirty (30) days advance written notice. The Customer, upon receipt of such a notice, may elect to discontinue his or her service by notice in writing to ARInternet, within said thirty (30) day period. Thereafter, the Customer shall be deemed to have agreed to and accepted, and to be bound by the modified price list and the Terms and Conditions then in effect. ARInternet shall bill the Customer monthly unless a quarterly, semiannual or annual payment plan, with term discounts as published in the most recent price list, has been requested by the Customer.Disclaimer:
ARInternet is not responsible for the content of information obtained via ARInternet or its services, and does not warrant the accuracy, correctness, currency or completeness of such information. The Customer acknowledges and agrees that information obtained via ARInternet's services may include views, opinions, and recommendations of other organizations and individuals, and that ARInternet is not responsible for and does not necessarily endorse those views, opinions or recommendations. Additional terms and conditions governing the use of information obtained via ARInternet may be imposed with respect to specific information sources, including further disclaimers or limitations of liability. The Customer agrees to indemnify and hold ARInternet harmless upon any claim made by a third party arising from and/or in connection with the Customer's use of the service.Limitation of Liability:
(A) IN NO EVENT SHALL ARINTERNET BE LIABLE TO CUSTOMER FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES OR LOST PROFITS ARISING OUT OF OR RELATED TO THIS AGREEMENT; THE PERFORMANCE OR BREACH THEREOF, OR THE ACCURACY OR CORRECTNESS OF THE INFORMATION OBTAINED VIA ARINTERNET OR ITS SERVICES, EVEN IF ARINTERNET HAS BEEN ADVISED OF THE POSSIBILITY THEREOF, ARINTERNET'S LIABILITY TO CUSTOMER HEREUNDER, IF ANY, SHALL IN NO EVENT EXCEED THE TOTAL AMOUNT CUSTOMER HAS PAID TO ARINTERNET HEREUNDER. (B) IN NO EVENT SHALL ARINTERNET BE LIABLE TO CUSTOMER FOR ANY DAMAGES RESULTING FROM OR RELATED TO ANY FAILURE OR DELAY OF ARINTERNET IN PROVIDING ACCESS TO THE INTERNET OR THE ACCURACY OR CORRECTNESS OF THE INFORMATION OBTAINED VIA ARINTERNET OR ITS SERVICES.Account Suspension and Cancellation:
ARInternet reserves the right to terminate service to the Customer for nonpayment of charges and/or failure to adhere to conditions of usage. ARInternet has the right to delete all data, files or other information that is stored in the Customer's account if the Customer's account with ARInternet is terminated, for any reason, by either ARInternet or the Customer. ARInternet warrants that, if a Customer is dissatisfied with the service, ARInternet will, upon written notification from the Customer to ARInternet, refund an amount of the service fee for the current period prorated from the date of receipt of said notification, and any prepaid fees for future months. Other than the foregoing, no warranty is made by the Company and ARInternet shall not be held liable for any damages or losses sustained by the Customer resulting from interruptions, changes, additions or deletions in service, losses of data, or suitability of service for any particular purpose, whether caused by the error, omissions, acts of negligence of ARInternet or others. To the extent that service is initiated or contracted for by purchase order, non-renewal of an expired purchase order is not notice of cancellation; rather, written notice, as noted above, must be provided.Terms of Agreement:
This Agreement between ARInternet and the Customer supersedes any prior oral or written agreements or representations. This Agreement may be modified only by a written Agreement properly executed by both ARInternet and the Customer. A failure by ARInternet to enforce any provision of this Agreement on one occasion shall not be a waiver of that provision upon a subsequent occasion. This Agreement shall be construed in accordance with the laws of the State of Maryland. Use of an ARInternet account constitutes acceptance of these Terms and Conditions.
